Defending an
Unfair Dismissal Claim
Employee who considers that he has been dismissed without just cause or excuse by his employer may make representations to the Director General to be reinstated in his former employment under Section 20 of the Industrial Relations Act 1967.
Taking into consideration that employees nowadays are getting more knowledgeable about their rights, you are strongly advised to appoint a lawyer to represent yourself in defending your claim.
It is your burden to prove that you have “just cause and excuse” for dismissing the employee and that the dismissal was done in good faith, failing which you will be ordered by the Industrial Court to reinstate your former employee / to pay compensation in lieu of reinstatement together with back wages of up to 24 months.
